TRIAL LAWYER

Josh is an attorney who specializes in complex civil litigation in all federal and state courts in Oklahoma, with an emphasis in federal litigation, employment law, constitutional law, civil rights, insurance bad faith, business law, and commercial litigation. 


He has served as lead trial counsel in numerous jury trials and has handled cases in courts across the country, including in Texas, New York, Georgia, South Carolina, Arkansas, and other states. 


He is admitted in all Oklahoma state courts, the United States Court of Appeals for the Tenth Circuit, the Oklahoma federal courts for the Western, Northern, and Eastern Districts of Oklahoma, and the Cheyenne and Arapaho Tribes of Oklahoma. 

COMPLEX LITIGATOR

Josh has extensive experience in complex civil litigation. He has successfully resolved cases for clients in cases involving employment law, constitutional law, civil rights, business & commercial litigation, class actions, bad faith insurance, catastrophic personal injuries,  and in appellate practice.


 Some of his representative cases include: 


  • a real estate development case in which Stockton Talbert obtained a $1,250,000 verdict for its client against the developer of a subdivision for inadequate roads.


  •  an education and employment civil rights case involving a doctor who brought claims under the Americans with Disabilities Act against his former residency program.


  • Walker v. BuildDirect.com Technologies, Inc., 2015 OK 30, a business litigation case that decided when online arbitration agreements are enforceable under Oklahoma law.


  • Atrium v. University of Central Oklahoma, 2014 OK CIV APP 84, 336 P.3d 478, a contract case regarding the ability of public educational institutions to enter into future contracts. 


  • a legal malpractice case filed against a former judge who went into private practice and failed to adequately represent a client, which resulted in a plaintiff's verdict against the former judge. 


  • Burris v. Novartis Animal Health U.S., Inc., Case No. 08-6030 (10th Cir. 2009), an employment case in which the 10th Circuit reinstated an employee's claim that he was fired in violation of the Family & Medical Leave Act.

OU SOONER

Josh graduated from the OU College of Law in 2007. While in law school, he received the George B. Fraser Scholarship for Outstanding Academics in Civil Procedure, American Jurisprudence Awards for Civil Procedure and Legal Research and Writing, became a member of Phi Kappa Phi Honor Society, and was on the Dean's Honor Roll. He studied law at Oxford University with the study abroad program in the summer of 2005. 


Josh also graduated from OU as an undergraduate in 2004  with a B.A. in Political Science and a minor in history. As a senior, he was awarded the Benson Undergraduate Paper Award, which is awarded for outstanding research and writing by an undergraduate in political science or public administration, for his analysis of the impact of the U.S. government's response to terrorism on American constitutional law. 

LAW NERD & FUTURE BEACH BUM

When he is not doing lawyery stuff, Josh is usually scheming about how to fulfill his lifelong dream of being a law nerd from a beach by the ocean. Or he has his face in a book or newspaper (or iPad) reading about history, politics, current events, or how to better fight for justice and civil rights. 


He also likes to write, drink coffee, watch the Sooners & Thunder, travel to see his large extended family, hang out with friends,  and watch movies. Lots of movies.  

GIVING BACK

Josh serves as general counsel for the Braden Bailess Memorial Foundation, a non-profit in Houston that raises money for wounded military veterans and their families. The foundation was formed by Josh's family in honor of his cousin Braden, a Marine who died in a car crash in 2002 prior to deployment. 


 He is a member of the Oklahoma Bar Association's Labor  & Employment, Litigation, Small Firm, and International Law Sections; the Federal Bar Association; the National & Oklahoma Employment Lawyers Associations; and the Oklahoma and Canadian County Bar Associations. 


He is a former member of the Board of Directors of The Education and Employment Ministry (TEEM), a non-profit in OKC focused on breaking cycles of incarceration and poverty through education, personal development, and work readiness training.
